GEORGE NEWS - Several ANC councillors in their official capacity as duly elected members of the George Council have been ordered to pay the legal costs for a court case that has been lost.
George Herald previously reported that it was the ANC as a political party that had lost the matter, but it has since been clarified that the order was granted against the ANC councillors of the George Council in their official capacity, and not against the African National Congress as an organisation.
The matter followed the use of some photographs showing ANC councillors at a municipal housing handover in DA campaign material, which led them to approach the court on an urgent basis. They argued that the inclusion of the images on the posters created the impression that their councillors endorsed the DA.
The George Municipality, Mayor Browen Johnson and the DA were the respondents in the case. The interim interdict against the executive mayor and George Municipality has been dismissed with costs, but it is unclear whether the DA is off the hook.
Despite numerous requests for clarity on the matter, no comment from the DA had been received by the time of going to press.
The ANC leader of the opposition on the George Council, Faith Mdaka, said the matter is not yet finalised.
"Part B of the application remains pending and has yet to be enrolled and adjudicated. The proceedings are therefore ongoing," she said, calling for a correction to reflect that the ANC as an organisation is not the litigant.
