GEORGE NEWS - Neither the position of George mayor nor the position of a proportional councillor in the George Council may be filled right away.
This is according to a ruling by the Western Cape High Court last Friday on a request by former mayor, Melvin Naik, to intervene against the DA's decision to strip him of his membership, and by implication his position as councillor and mayor.
The court ruling states that the DA may not fill these positions until a ruling has been made between Mark Willemse, the former mayor of Knysna, and the DA party.
According to an informed source, Willemse's case is very similar to that of Naik. Willemse also took the matter to court for "unfair" termination of his DA membership.
Naik's attorney, Winston Jansen, confirmed the court ruling on Friday. He said he could not give further comment at this stage, since the case is sub judice.
DA regional chair Jaco Londt said there is no settlement with Naik. "We are merely waiting to see what course the Willemse case will take, because both matters were dealt with through the so-called recall clause. If the judge rules on the constitutionality of the clause, it might have an impact on the Naik matter."
Meanwhile, Edmund Bussack, Belrina Cornelius and David Willemse, the three DA councillors who lost their party membership last week, are also seeking legal help to fight their case in court.
Bussack confirmed that they are currently awaiting feedback from their legal representatives.
