The teacher was supposed to appear in the Thembalethu Regional Court in George today after pleading not guilty on 7 December 2015, but his case was struck off the roll due to the passing of Magistrate Thembekile Anna, who died on Monday 8 February after a long battle with cancer.
The teacher is accused of wrongfully and intentionally assaulting a female pupil (then 14 years old) on several occasions during 2013; touching the victim's legs without her permission and biting her upper arm or shoulder. A second alternative charge of crimen injuria followed after the accused allegedly made remarks to the victim with reference to her "big nice bum".
According to court officials, a new magistrate will take over and the teacher will be notified of the new court date.
