The court has issued a new directive to Sassa and minister Bathabile Dlamini to file affidavits by 3pm on Tuesday afternoon to explain why they missed yesterday's deadline.
The court wants clarity on the contract between Sassa and Cash Paymaster Services (CPS) after it declared that contract invalid in 2014.
The Social Development Minister Dlamini and Sassa missed the 4pm deadline on Monday. They later confirmed that the documents were electronically submitted with answers on Monday night.
They are due to present their case in court tomorrow.
