GEORGE NEWS - Four former Tekkie Town executives and its founder, Braam van Huyssteen, have made some headway in one of their legal battles with the Steinhoff subsidiary Pepkor, current owner of Tekkie Town.
On Thursday last week Judge Elizabeth Baartman dismissed Pepkor's application to change a court order against the former executives and to introduce an annexure to her judgement.
The annexure refers to a list of footwear that Pepkor had failed to produce in their restraint application. It was meant to prevent the former executives from trading in certain footwear ranges.
The footwear would apparently have been sold by Tekkie Town before the business was exchanged by Van Huyssteen and his executive team for Steinhoff shares, which later proved to be worthless.
Four months after their restraint application, Pepkor had still not provided the list of the prohibited footwear.
"Pepkor, despite a commitment to do so, never provided the respondents or the court with this list and then attempted to portray the order as an order not only against Braam and his team, but also against start-up Mr. Tekkie," said Bernard Mostert, former Tekkie Town CEO and now Mr. Tekkie CEO.
"Despite their attempts to publish three different lists over a period of almost four months, it is clear that they tried to be judge and juror in respect of the list. We are grateful that Judge Baartman dismissed Pepkor's application to introduce a list that was never in front of the court and ourselves."
On Monday, Baartman also granted the former executives and Van Huyssteen leave to appeal against her original restraint of trade ruling. Van Huyssteen said their first focus is still on building their new business, Mr. Tekkie.
"Our second focus is to regain the ownership of Tekkie Town which we lost due to the alleged fraud in Steinhoff. We will not rest until we have succeeded in this pursuit."
